Early Birdies – Terms of Use

Welcome to Early Birdies. These Terms of Use (“Terms”) govern your access to and use of the Early Birdies mobile application and website (collectively, the “Service”), owned and operated by Tech Itch Labs LLC, a Florida limited liability company (“Tech Itch Labs,” “we,” “our,” or “us”).

By accessing or using Early Birdies, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Overview of Early Birdies

Early Birdies is a digital tool designed to help golfers discover and receive notifications about early morning and canceled tee times at golf courses. The Service provides aggregated course availability data to help users make informed decisions about booking tee times.

We are not affiliated with, endorsed by, or officially partnered with any golf courses listed on the app or website. Course availability, pricing, and booking policies are subject to change and are controlled solely by the individual golf courses.

2. Eligibility

You must be at least 18 years of age or the age of majority in your jurisdiction to use the Service. By using the Service, you represent and warrant that you meet these requirements.

3. Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

Use the Service in any manner that violates any applicable law or regulation;
Impersonate any person or entity;
Use the Service in a way that could disable, damage, or impair our systems;
Interfere with any other user’s use of the Service;
Use automated scripts or bots to access or scrape the Service without our prior written consent.

We reserve the right to suspend or terminate your access to the Service at any time if we believe you have violated these Terms.

4. Course Information Disclaimer

Early Birdies provides information about golf course availability and tee time cancellations as a convenience to users. This information may include third-party data, user-submitted details, or publicly available information.

Tech Itch Labs LLC does not guarantee the accuracy, completeness, reliability, or availability of any course information displayed. All bookings, payments, disputes, and scheduling matters must be handled directly with the course operator. Tech Itch Labs is not responsible for missed tee times, incorrect pricing, or course policy changes.

5. Intellectual Property

The Service, including all content, features, and functionality, is the property of Tech Itch Labs LLC and is protected by U.S. and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any part of the Service without our prior written consent.

6. User Content

You may submit information, preferences, or other content to the Service (“User Content”). By submitting User Content, you grant Tech Itch Labs a non-exclusive, royalty-free, worldwide, sublicensable license to use, reproduce, and display that content in connection with operating the Service.

You represent and warrant that you have the right to submit any User Content you provide and that it does not infringe the rights of any third party.

7. Privacy

Your use of the Service is also governed by our [Privacy Policy], which explains how we collect, use, and share your information. By using the Service, you consent to the collection and use of your data in accordance with our Privacy Policy.

8. Limitation of Liability

We do not guarantee uninterrupted or error-free operation of the Service, and we are not responsible for delays, failures, or disruptions caused by third parties or factors beyond our control.

You agree to indemnify and hold harmless Tech Itch Labs LLC, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your violation of these Terms, or your infringement of any rights of a third party.

We may update these Terms from time to time. If we make material changes, we will notify you via the Service or by email. Your continued use of the Service after any such update constitutes your acceptance of the revised Terms.

11. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. You agree that any disputes arising out of or relating to the Service shall be subject to the exclusive jurisdiction and venue of the state and federal courts located in Florida.

13. Subscription Terms and Limitations

By subscribing to a paid plan on Early Birdies (“Pro Subscription”), you acknowledge and agree to the following:

Early Birdies does not control or influence the availability of tee times at any golf course listed within the app. We do not own, manage, or have any contractual relationship with the golf courses shown.
The Service is designed to notify you of available or canceled tee times based on the preferences and rules you set. However, we do not guarantee that a tee time will become available, nor that you will be notified in time to secure it.
Notifications are dependent on data availability, course update frequencies, user configuration settings, and technical conditions beyond our control.
By subscribing, you understand that Early Birdies is a tool for monitoring availability, not a booking service, and your subscription does not entitle you to a guaranteed tee time.
No refunds will be issued in the event that no tee times become available during your subscription period, or if you are not notified of an availability that does occur.

We strongly encourage users to maintain realistic expectations and understand that Pro features are designed to increase your chances, not ensure results.
